1. Engineering disclaimer
First Out AI supports engineering work and does not replace engineering judgement. Results must be reviewed and confirmed by a competent functional safety engineer before they are used in design, operation or any safety decision. First Out AI is not certified software and has not been assessed by a certification body.
The user remains responsible for the safety lifecycle, the selection of methods and data, the input values, the interpretation of results and compliance with applicable standards and regulations, including IEC 61511 and IEC 61508.
2. Intended use
First Out AI is intended for qualified engineers who understand the methods it implements. It calculates using the published methods described on the methods page, with the limits of validity stated there.
3. Plans, purchase and payment
The free plan needs no account and may be changed or limited at any time. Paid plans are described on the pricing page.
Online purchases are made through Paddle, which sells First Out AI as merchant of record: Paddle.com Market Limited, or Paddle.com Inc in the United States and Paddle.com (Canada) Ltd in Canada. Paddle takes the payment, issues the invoice, charges the applicable tax and handles refunds under its buyer terms. Plans bought by quote and invoice are governed by the written agreement for that order.
Monthly and annual plans renew automatically until cancelled. You can cancel at any time from the link in your Paddle receipt; the plan stays active until the end of the paid period. Project Pass is a single payment for 90 days and does not renew. Refunds follow the refund policy.
4. Licence keys
Access is given by a licence key sent to the buyer's email address. The owner of a Project Pass, Team or Enterprise plan can create member keys for the remaining users of the plan; the owner counts as one user. Keys are personal to the user they are issued to and must be kept confidential. A key that is shared outside the plan may be replaced.
5. Questions to the engineer
Paid plans include a number of questions each calendar month (Pro 2, Project Pass 3, Team 6, Enterprise 10), asked from inside First Out AI and answered by Ali Telek by email, normally within three working days. Questions concern functional safety methods and the use of First Out AI. Answers are general engineering guidance: they are not a review or approval of your project, do not create an engagement, and do not replace verification by a competent functional safety engineer. Unused questions do not carry over, and the allowance is shared by all users of a licence. Do not include confidential plant data in a question.
6. First Out AI
Paid plans include a number of First Out AI questions each calendar month (Pro and Project Pass 300, Team 1,500, Enterprise 5,000), shared by all users of a licence and not carried over. Top-up questions can be bought separately; they do not expire while the licence is valid. When you ask, your question, the inputs of the function and the engine result are sent to Anthropic, which provides the Claude model that writes the answer. Anthropic's commercial terms do not allow it to train models on this content.
Answers are generated by an AI model and can be wrong or incomplete. Do not rely on any factual statement in an answer without checking it yourself; answers do not change the engine result, are not a review or approval of your design, and do not replace verification by a competent functional safety engineer. If the AI service is unavailable or the allowance is used, First Out AI keeps calculating; only the AI answers pause. Do not include confidential plant data or personal data in a question.
7. Licence
A subscription gives the named users of your plan a non-exclusive, non-transferable right to use First Out AI for the paid period. You may not copy, resell, reverse engineer or attempt to extract the calculation engine. Reports you generate are yours to use without restriction.
8. Your data
Project data belongs to you. It is used only to provide the service, is not used to train AI models by firstout.ai or by Anthropic under its commercial terms, and can be exported or deleted by you at any time. See the privacy notice for how personal data is handled.
You confirm that you have the right to use any failure-rate data you enter, including data from licensed databases.
9. Availability
Reasonable efforts are made to keep the service available, but no specific availability is guaranteed outside an Enterprise agreement. Planned maintenance is announced in advance where possible.
10. Limitation of liability
First Out AI is provided "as is". To the extent permitted by law, there is no warranty that results are free of error or fit for a particular purpose, and liability for any claim is limited to the fees you paid for First Out AI in the twelve months before the claim. There is no liability for indirect or consequential loss, including loss of production or profit. Nothing in these terms limits liability that cannot be limited by law.
11. Changes
These terms may be updated. The date at the top shows the current version; changes that reduce your rights during a paid period apply from the next renewal.
